SUBPART – GEN (ATS.GEN) ADDITIONAL GENERAL REQUIREMENTS FOR PROVIDERS OF AIR TRAFFIC SERVICES

  • ATS.GEN.001 Scope & applicability
    • This subpart applies to all Air Traffic Service Providers.
    • It details additional general requirements supplementary to PART ANSP.
  • ATS.GEN.010 Certification of air traffic services
    • Air Traffic Service provision requires a valid Air Navigation Service Provider certificate with privileges for the relevant air traffic services.
    • The ANSP certificate must indicate the privileges and authorized locations.
    • The Service Provider must comply with the relevant subparts of this regulation.
    • The certification of air traffic services is divided as follows:
    • Air Traffic Control Services: Area Control, Approach Control, Aerodrome Control.
    • Flight Information Services: Flight Information Service, Aerodrome Flight Information Service.
    • Alerting Service.
    • A person or organization may request the Authority to determine if a service is considered an air traffic service.
  • ATS.GEN.020 Establishment of Service
    • An organization intending to establish an Air Traffic Service should include with its application:
    • A schedule of proposed service hours for the first 12 months.
    • A copy of the safety study leading to the decision to provide the service.
    • The proposed airspace classification and division of responsibilities.
    • Competency and experience requirements for the unit.
    • Curriculum Vitae of proposed initial personnel.
    • Training Needs Analysis for all personnel.
    • Training & implementation plan.
  • ATS.GEN.030 Transfer of Service
    • An organization assuming responsibility for an air traffic service from an existing provider must include details of transitional arrangements.
    • The outgoing Service Provider must not hinder transitional arrangements.
    • Incoming service provider should provide the Authority:
    • 180 days prior to transition date: formal notification of intention to assume a service, including transition plan.
    • 90 days prior to transition date: submission of all documentation related to transition arrangements and certification requirements.
    • 30 days prior to transition date: written confirmation of transition date from the Accountable Manager of each organization.
    • Transitional arrangements should include:
    • Access to inspect facilities, relevant operational procedures, safety information, and statistical data.
    • Nomination and/or handover of relevant Post Holders.
    • Details and qualifications of personnel transitioning.
    • Regular transition meetings.
    • A transition plan with milestones and critical decision points.
    • A contingency plan.
    • Potential incoming Service Provider should be certified before signing contracts for the provision of ATS.

  • ATS.GEN.040 Ownership
    • A Service Provider must prevent any conflict of interests that could compromise impartiality.
      Section 1 – Coordination
  • ATS.GEN.105 Formal Arrangements
    • A Service Provider must ensure that any formal arrangements with third parties are documented.
    • Formal arrangements should form a written agreement such as Letter of Agreement, Service Level Agreement, Memorandum of Understanding, or Service Contract.
    • Each arrangement should contain necessary details for appropriate and effective coordination.
    • Formal arrangements should be authorized by an appropriate signatory and reviewed regularly.
    • Formal arrangements should form part of the applicant’s operations manual.
  • ATS.GEN.110 Coordination between aerodrome operators and Service Providers
    • A Service Provider must establish arrangements with the aerodrome operator to ensure adequate coordination and exchange of relevant data and information.
    • The Service Provider, in coordination with the aerodrome operator, should:
    • Assess the necessity for establishing standard routes for taxiing aircraft.
    • Establish arrangements for information exchange on aerodrome conditions and the operational status of aerodrome facilities.
    • Establish arrangements for apron management services, including a coordination procedure.
    • Establish arrangements for low-visibility operations and the definition of responsibilities.
    • Coordinate for routine and non-routine runway inspections.
    • Inform the aerodrome operator of any unreported condition pertaining to safe use of the maneuvering area, and terminate operations until advised otherwise by the aerodrome operator.
    • Forward runway conditions and details of aerodrome safety management programs.
    • The Service Provider should establish close coordination with the aerodrome operator to participate in developing the aerodrome manual and analyze safety incidents and trends.
  • ATS.GEN.120 Coordination between military units and Service Providers
    • Service Providers must establish and maintain close cooperation with military authorities.
    • Coordination of activities potentially hazardous to civil aircraft must be effected in accordance with ATS.GEN.130.
    • Arrangements must be made to permit prompt information exchange between air traffic services units and appropriate military units.
    • Air traffic services units must, either routinely or on request, provide appropriate military units with pertinent flight plan and other data concerning civil aircraft.
    • Air traffic services authorities must designate areas or routes where flight plan requirements apply to all flights to facilitate civil aircraft identification.
    • Special procedures shall be established to ensure:
    • Air traffic services units are notified if a military unit observes an aircraft approaching an area requiring interception.
    • All efforts are made to confirm the identity of the aircraft and provide navigational guidance.
  • ATS.GEN.130 Coordination of activities potentially hazardous to civil aircraft
    • The arrangements for activities potentially hazardous to civil aircraft must be coordinated with the appropriate air traffic services units.
    • Coordination must be effected early enough to permit timely information promulgation.
    • The Service Provider must ensure a safety risk assessment is conducted for such activities and risk mitigation measures are implemented.
    • The organization or unit conducting or identifying activities potentially hazardous to civil aircraft should be invited to contribute to the safety risk assessment.
    • The Service provider is responsible for initiating the promulgation of information.
  • ATS.GEN.140 Coordination between meteorological services providers and Service Providers
    • To ensure aircraft receive up-to-date meteorological information, A Service Provider must arrange for air traffic services personnel:
    • To report additional meteorological elements and phenomena.
    • To report meteorological phenomena of operational significance as soon as possible.
    • To report pertinent information concerning volcanic ash cloud.
    • A Service Provider must ensure close coordination between area control centers and meteorological watch offices, ensuring consistency on volcanic ash information.
  • ATS.GEN.150 Coordination between aeronautical information services and Service Providers
    • A Service Provider must provide the aeronautical information to the relevant aeronautical information services.
    • To ensure aeronautical information services providers obtain information, A Service Provider must report to the responsible aeronautical information services provider:
    • Information on aerodrome conditions.
    • The operational status of associated facilities, services, and navigation aids.
    • The occurrence of volcanic activity.
    • Any other information of operational significance.
    • Before introducing changes to systems for air navigation, A Service Provider must:
    • Ensure close coordination with the aeronautical information services provider(s) concerned.
    • Consider the time needed by the aeronautical information services provider.
    • Provide information in a timely manner to the aeronautical information services provider concerned.
    • A Service Provider must observe aeronautical information regulation and control (AIRAC) effective dates.
  • ATS.GEN.160 Coordination between Communication, Navigation, & Surveillance (CNS) services and Service Providers
  • ATS.GEN.170 Coordination between other major stakeholders and Service Providers
    • A Service Provider must ensure adequate coordination is maintained between ATS units and appropriate major stakeholders.
    • Air traffic services units must respect the requirements of operators and make available relevant information.
    • Air traffic services units should make available to the operator messages relating to the operation of the aircraft.
    • The service provider should maintain appropriate formal arrangements with any organization
      It interacts with for flight procedures.
    • The service provider should establish formal arrangements including coordination and communication systems with search and rescue coordination centers.
    • If the Service Provider provides Aerodrome Control or Aerodrome Flight Information Services, they should establish appropriate communication systems and coordination by formal arrangement with the Aerodrome Rescue & Firefighting Services.
    • The service provider may also establish appropriate co-ordination and communication systems with any other entity that may require close coordination and/or time critical communication.
      Section 2 – ATS Facilities & Infrastructure
  • ATS.GEN.205 ATS Facilities
    • A service provider must establish the following facilities appropriate to the services on their certificate:
    • Aerodrome control towers.
    • Approach control units Co-located within an Area Control Center, but not within the Visual Control Room.
    • Area control centers.
    • Equipment must have reliability, availability, and redundancy.
    • ATS facilities must have adequate facilities for staff on break periods, temperature/humidity/ventilation/noise/lighting controls, evacuation routes, and suitable access and egress.
    • An aerodrome control tower should:
    • Be constructed and situated to provide:
      • Maximum visibility of aerodrome traffic from the controller working positions.
      • Sufficient working area for the intended number of positions.
      • Protection from glare and reflection.
      • Protection from noise.
    • Be safeguarded from any development that would affect these requirements.
    • At solo watch locations, be provided with toilet facilities to ensure the minimum possible interruption to, or degradation of, ATS.
    • An Aerodrome Control Tower should be provided with:
    • a display system designed to show disposition of aerodrome traffic.
    • a power supply, window blinds, maps/charts, binoculars, clocks, a log keeping system, outside temperature indicator, and QNH displays.
    • a signal lamp with green, red, and white functions, telephone communications, status indicators for approach and landing aids, and data recording equipment.
    • wind direction and speed displays related to the same direction of observation.
    • an audible emergency alerting system, AFTN terminal, displays for runway visual range and cloud base height (where available).
    • Surface movement surveillance should be utilized to:
    • Monitor the movement of aircraft on the maneuvering area.
    • Provide directional information to pilots.
    • Provide advice and assistance for safe and efficient movement.
    • An aerodrome control tower should be provided with surface movement surveillance where services are provided to operations in visibility conditions of less than 550m.
    • ATS surveillance system should consist of, in order of preference:
    • ADS-B or MLAT.
    • Surface Movement Radar.
    • Personnel should be trained in the use and limitations of the system.
    • An approach control unit should be provided with:
    • Display systems, power supply, maps/charts, clocks, a log keeping system, status indicators, telephone communications, and voice and data recording equipment.
    • Display for wind direction/speed, RVR, and height of cloud base.
    • An area control center should be provided with:
    • Display systems, power supply, maps/charts, clocks, a log keeping system, status indicators, telephone communications, and voice and data recording equipment.
  • ATS.GEN.210 Security
    • The Service Provider must prepare an ATC security program that specifies physical security requirements, practices, and procedures to minimize risks to ATC Units.
    • The security program must ensure:
    • Entrances to ATC facilities are positively controlled.
    • Unattended facilities are monitored for intrusion.
    • Personnel on duty are protected.
    • Protocols are followed in the event of a threat of violence against an ATC Unit.
  • ATS.GEN.220 Service Disruptions
    • The Service Provider must establish procedures to:
    • Advise the Authority of any planned disruption to ATS.
    • Investigate any unplanned disruption.
    • Report unplanned disruptions to the Authority within 48 hours when they affected safety.
    • Reportable disruptions should include failure to open watch within 15 min of promulgated opening time, interruption of ATC service over 10 min, and curtailment of watch over 30 min.
  • ATS.GEN.230 Temporary facilities
    • A temporary aerodrome control tower/flight information office doesn't need to be provided with: Status indicators for approach/landing aids, AFTN terminal, or airfield lighting control panel.
    • If it is impracticable to do so and other appropriate measures are taken, as the case may be to:
    • Provide the person/s providing the air traffic control service from the temporary tower or unit with the information that would be available from the equipment.
    • Control the aerodrome lighting if applicable
  • ATS.GEN.240 Contingency Facilities
    • ATS contingency facilities intended to support ongoing services must meet the requirements in ATS.GEN.205.
    • Where contingency facilities are not intended to support continuity of service, procedures must describe available service and circumstances.
      Section 3 – Air Traffic Service Incidents
  • ATS.GEN.305 Reporting of ATS incidents
    • A Service Provider must report any occurrence believed to be a flight safety issue, as required in CAR-OCR.
    • The Service Provider should notify the Authority as soon as practicable in the event of an Accident, AIRPROX or Serious Incident.
    • ATS personnel should be trained in submitting accurate, unambiguous, and comprehensive incident reports.
  • ATS.GEN.310 Incidents involving other parties
    • Controllers must ensure that other parties involved in an incident are aware it occurred and that reporting action is taken, considering timing, workload, and flight crew performance.
  • ATS.GEN.315 Reporting of ATS incidents in adjacent airspace
    • If ATC Unit becomes aware of an AIRPROX that occurred in an adjacent FIR, the ATC Unit must ensure that the relevant ATC Unit in that FIR is notified of the AIRPROX. Also, submit ROSI.
  • ATS.GEN.320 Positive reporting culture
    • Service providers must not perform disciplinary actions that might inhibit staff from reporting incidents.
    • Where issues with performance or competence are detected, this should be managed through the Training and Competency System
  • ATS.GEN.330 ATS investigations
    • It is the Service Provider’s responsibility to initiate and conduct an investigation of ATC occurrences for which a safety performance target has been established and as determined that an investigation is warranted under their SMS.
    • Statements, transcripts and related investigative data are to be compiled, and a report submitted to the Authority within 20 working days of the GCAA ROSI acceptance.
    • The investigation should be conducted by an impartial person and in line with the principles of just culture. Personnel potentially involved in an ATC occurrence should not be involved in the conduct of the investigation.
    • Learning outcomes from incident investigations should be provided to front-line operational staff.
  • ATS.GEN.340 Relief from Duty
    • An ATCO whose actions may have been a contributing factor in an ATC occurrence where the safety of an aircraft was or may have been jeopardized must be relieved as soon as reasonably practicable from all operational duties pending a unit investigation.
    • After an accident or serious incident, an ATCO relieved from duty must not be returned to operational duties without approval from the Authority.
    • The Operations Management in this context would normally include the Post Holders for Operations, Training, and Safety.
      Section 4 - Miscellaneous
  • ATS.GEN.410 Airspace Classification
    • ATS airspace should be classified in accordance with CAR-ASP PART-ASM.
    • A Service Provider must ensure that the services provided are aligned with airspace classifications.
    • A Service Provider should perform an airspace review at least once every 5 years.
  • ATS.GEN.420 Airspace Changes
    • A Service Provider must ensure all airspace changes are performed in accordance with CAR-ASP PART-ASM.
  • ATS.GEN.430 Time in Air Traffic Services
    • A Service Provider must ensure that air traffic services units are equipped with clocks indicating the time in hours, minutes, and seconds, clearly visible from each operating position.
    • Air traffic services units' clocks and other time-recording devices must be checked as needed to ensure accurate time to within ± 5 seconds of UTC. Where data link communications are used, clocks must be checked as needed to ensure accurate time to within 1 second of UTC.
  • ATS.GEN.440 Contingency arrangements
    • A Service Provider must develop contingency plans required by point ANSP.GEN.160 in close coordination with adjacent service providers and airspace users.
    • Contingency plans related to the evacuation of each ATC operational facility should be practiced annually.
    • If a volcanic ash cloud is reported or forecast, relay pertinent information immediately to flight crews whose aircraft could be affected.
  • ATS.GEN.450 Emergency response planning
    • A Service Provider must develop, coordinate, and maintain an emergency response plan.
    • The plan should reflect the nature and complexity of activities, ensure a transition from normal to emergency operations, and coordinate with other organizations ERPs.
    • The plan should be aligned with the aerodrome ERP and coordinated with the aerodrome operator.
    • Emergencies may include: aircraft emergencies, natural phenomena, acts of terrorism, loss of communication, and loss of air traffic services unit.
  • ATS.GEN.460 Failure and irregularity of systems and equipment
    • ATS personnel must immediately report any failure or irregularity of communication, navigation, and surveillance systems that could adversely affect the safety or efficiency of flight operations.
  • ATS.GEN.470 Trials
    • The Authority may approve trials regarding:
    • Reduced separation minima.
    • New operating procedures or routes.
    • Standard phraseology.
    • ATS surveillance procedures.
    • Data link procedures.
    • The application should include a safety assessment.

SUBPART – ORG (ATS.ORG) ADDITIONAL ORGANISATION REQUIREMENTS FOR ATS PROVIDERS

  • ATS.ORG.001 Scope & applicability
    • This subpart prescribes additional organizational requirements for providers of air traffic services. It applies to all Service Providers with the privilege to provide air traffic services.
      Section 1 - Safety of Services
  • ATS.ORG.100 Safety management system
    • A Service Provider must have in place a safety management system (SMS) that complies with the requirements detailed in CAR-SMS and the additional requirements in CAR-ANS PART ANSP.
  • ATS.ORG.110 Safety assessment and assurance of changes to the functional system
    • For any change notified in accordance with point ANSP.ORG.450, the Service Provider must:
    • Ensure a safety assessment is carried out covering the scope of the change.
    • Provide assurance that the safety mitigations identified are valid.
    • A Service Provider must ensure that the safety assessment comprises:
    • Hazard identification.
    • Determination and justification of safety criteria.
    • Risk analysis.
    • Risk evaluation and mitigation.
    • Verification that the assessment corresponds to the scope of the change and that the change meets safety criteria.
    • Specification of monitoring criteria.
  • ATS.ORG.120 Safety Performance Monitoring
    • A Service Provider must define safety performance indicators, safety performance targets, and alert levels. Should be applicable, in which an ATC staff member’s action, were contributory to the occurrence:
    • Airborne Separation Minima Infringement (ASMI) Category A & B
    • ASMI Category C & D
    • ASMI Category E
    • Loss of Runway Separation Category A & B
    • Loss of Runway Separation Category C & D
    • Runway Incursion Category A & B
    • Runway Incursion Category C & D

    • The safety performance indicators, safety performance targets and alert levels should be calculated quantitatively in accordance with ICAO Doc 9859
    • A Service Provider must comply with any request for information deemed necessary by the Authority on safety performance.
      Section 2 – ATS Specific Personnel
  • ATS.ORG.210 ATS Post Holders
    • In addition to the Post Holder requirements for all Air Navigation Service Providers detailed in ANSP.ORG.210, in an Air Traffic Service Provider:
    • The Operations Post Holder is responsible for the operation of the air traffic service.
    • The Training Post Holder must ensure:
      • Unit training is effectively managed.
      • Individual training records are maintained.
      • Instructors are competent.
      • On-the-job training is properly conducted.
      • Students are appropriately licensed prior to commencing OJT.
      • The Training and Competency Manual is reviewed annually.
      • External training courses are approved by the Authority.
    • The Safety Post Holder is responsible for the development, administration, and maintenance of an effective SMS, hazard identification, risk analysis, and management, implementation of actions taken to mitigate risks, provide periodic reports on safety performance and advice on safety matters.
    • The Quality Post Holder is responsible for the effectiveness of the Quality Managements System.
  • ATS.ORG.220 Licensing and medical certification requirements for air traffic controllers
    • A Service Provider must ensure that air traffic controllers: are properly licensed and hold a valid medical certificate in accordance with CAR-ATCO, only exercise their privileges when familiar with current information, comply with medical endorsements/conditions, and, hold a current CoC.
    • Service Provider to facilitate controllers to comply with recent experience requirements.
    • Licence holders cannot exercise privileges if medically unfit and shall notify the relevant air navigation service provider of their inability to do so.
    • Ensure Safety-sensitive personnel are not under the influence of any psychoactive substance
  • ATS.ORG.230 Licensed personnel
    • The Service Provider must ensure that licenced personnel maintain currency and comply with licence and medical requirements.
  • ATS.ORG.240 Licenced Administrative Personnel
    • Where licensed personnel primarily perform administrative functions, the Service Provider must ensure competence and proficiency is maintained.
    • A competence & proficiency management plan should be developed and maintained for each administrative personnel that maintain a licenced operational function.
      Section 3 - Human Factors Requirements for Air Traffic Control Service Providers
  • ATS.ORG.301 Scope
    • This section establishes human factors requirements for air traffic control service providers, to:
    • Prevent and mitigate air traffic control service by air traffic controllers with problematic use of psychoactive substances.
    • Prevent and mitigate the negative effects of stress on air traffic controllers to ensure the safety of air traffic.
    • Prevent and mitigate the negative effects of fatigue on air traffic controllers to ensure the safety of air traffic.
  • ATS.ORG.305 Responsibilities of air traffic control service providers with regard to the problematic use of psychoactive substances by air traffic controllers
    • An air traffic control service provider must refer to CAR-PSMP for psychoactive substances management requirements.
  • ATS.ORG.310 Stress
    • In accordance with ATS.ORG.100, an air traffic control service provider must:
    • Develop and maintain a policy for controllers' stress management, including a critical incident stress management program.
    • Provide controllers with education and information programs on the prevention of stress.

SUBPART – OPS (ATS.OPS) TECHNICAL REQUIREMENTS FOR PROVIDERS OF AIR TRAFFIC SERVICES

  • ATS.OPS.001 Scope & applicability
    • This subpart prescribes general requirements for the provision of all air traffic services. It applies to all Service Providers with air traffic service privileges.

    • The Service Provider must provide and keep up-to-date its operations manuals relating to the provision of services required by ANSP.ORG.310.
    • Operations Manual must include all procedures necessary to facilitate the requirements of the relevant Subpart of PART-ATS and ATS relevant provisions of Rules of the Air (CAR-ROA).
      Section 1 — General Requirements
  • ATS.OPS.100 Objectives of the air traffic services (ATS)
    • The objectives of the air traffic services shall be to:
    • prevent collisions between aircraft;Airspace for flexible use.
    • Prevent collisions between aircraft on the maneuvering area and obstructions on that area.
    • Expedite and maintain an orderly flow of air traffic.
    • Provide advice and information useful for the safe and efficient conduct of flights.
    • Notify appropriate organisations regarding aircraft in need of search and rescue aid, and assist such organisations as required
  • ATS.OPS.105 Divisions of the air traffic services
    • The air traffic services shall comprise the services identified as follows:
    • The air traffic control service, to accomplish the objectives as in points (a)(1), (2) and (3) of point ATS.OPS.100, this service being divided in three parts as follows:
      • Area control service
      • Approach control service
      • Aerodrome control service
    • Flight information service or air traffic advisory service, or both, to accomplish the objective established in point (a)(4) of point ATS.OPS.100;
    • The alerting service, to accomplish the objective established in point (a)(5) of point ATS.OPS.100
  • ATS.OPS.110 Establishment of the units providing air traffic services
    • Various units shall be established to provide air traffic services including:
    • Flight information centers for flight information service and the alerting service.
    • Air traffic control units for the control, the flight information, and alerting service.
    • AFIS or FIS units for flight information service and the alerting service.
    • Reporting offices for receiving flight plans.

    • Air traffic services units must be unambiguously named with suffixes as appropriate:

    • A Service Provider must establish procedures for the operation of aeronautical ground lights, whether or not they are on or in the vicinity of an aerodrome.
  • ATS.OPS.150 ATS surveillance services
    • A Service Provider may use ATS surveillance systems in the provision of air traffic services.
    • The Service Provider must specify the functions for which ATS surveillance information is used.
    • The Service Provider must:
    • Ensure that the ATS surveillance system or systems in use provide a continuously updated presentation of surveillance information.
    • Determine the number of aircraft simultaneously provided with ATS surveillance services which can be safely handled under the prevailing circumstances
    • Provide air traffic controllers with information concerning established minimum flight altitudes and correction of the effects of low temperatures on the minimum altitudes.
    • A ServiceProvider must establish procedures for: Establishing aircraft identification, position information, vectoring aircraft, providing navigation assistance, providing information regarding adverse weather, transferring control of aircraft, failure of ATS surveillance system or systems, SSR transponder failure, ATS surveillance-based safety-related alerts and warnings, and interruption or termination of ATS surveillance service.
    • Before providing an ATS surveillance service to an aircraft, identification must be established and the pilot informed.
    • If identification is lost, the pilot must be informed and, if applicable, appropriate instructions must be issued.
    • Only verified pressure-altitude-derived level information can be used to determine that aircraft maintained a level, vacated a level, pass a level or reach a level.

    • A Service Provider must ensure that information on aircraft movements, together with a record of ATC clearances issued to such aircraft, is displayed to maintain an efficient flow of air traffic with adequate separation.

    • The Service Providershall ensure services are provided to aircraft in a priority that ensures a safe and efficient flow of air traffic. I.E. Emergency aircraft.
      Section 2 - Requirements for Communications
  • ATS.OPS.200 Aeronautical mobile service (air-ground communications) – general
    • A Service Provider shall use voice or data link, or both, in air-ground communications for air traffic services purposes.
    • Recording facilities shall be provided on all air-ground communication channels.
  • ATS.OPS.205 Use and availability of the VHF emergency frequency
    • The VHF emergency frequency (121.500 MHz) must only be used for genuine emergency purposes.
    • A Service Provider must provide the frequency 121.500 MHz at: all area control centers, aerodrome control towers/approach control units serving international aerodromes, and any additional location designated by the Authority.
