Classification of Murder

Murder Types:
- First Degree Murder:
- Planned and deliberate.
- Includes contracted murder (money or value exchange for causing death).
- Applies if the victim is:
  - A peace officer acting in their duties.
  - A prison officer acting in their duties.
  - A person working in a prison with permission.
- First degree when committed during or attempting:
  - Hijacking (Section 76)
  - Sexual assault (Sections 271, 272, 273)
  - Kidnapping (Section 279)
  - Hostage taking (Section 279.1)
- During a criminal harassment (Section 264).
- During terrorist activity or for a criminal organization.
- During intimidation (Section 423.1).
- Second Degree Murder:
- Any murder not classified as first degree murder is second degree murder.
