Classification of Murder

  • Murder Types:

    • First Degree Murder:

    • Planned and deliberate.

    • Includes contracted murder (money or value exchange for causing death).

    • Applies if the victim is:

      • A peace officer acting in their duties.

      • A prison officer acting in their duties.

      • A person working in a prison with permission.

    • First degree when committed during or attempting:

      • Hijacking (Section 76)

      • Sexual assault (Sections 271, 272, 273)

      • Kidnapping (Section 279)

      • Hostage taking (Section 279.1)

    • During a criminal harassment (Section 264).

    • During terrorist activity or for a criminal organization.

    • During intimidation (Section 423.1).

    • Second Degree Murder:

    • Any murder not classified as first degree murder is second degree murder.
