‘Public View’ under SC/ST Act
Legal Precedent: The Bombay High Court and Supreme Court have quashed cases (such as the Afshamaskar Pathan case and a revenue-inspector case) emphasizing that for an offense under the SC/ST Act, the insult must occur “in public view.” This is consistent with the Hitesh Verma precedent.
Definition of Public View: “Public view” is defined as the presence of a third person or persons who are able to witness or hear the caste-based slur or insult. Therefore, an insult made in a private chamber or within a private conversation without independent witnesses does not meet this criterion.
Act Provisions: Sections and of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act of explicitly require both the act of caste abuse and its occurrence in “public view” for charges to be brought.
Constitutional Safeguards: These rulings are rooted in constitutional safeguards, particularly Articles (prohibition of discrimination on grounds of religion, race, caste, sex or place of birth), (abolition of untouchability), and (protection of life and personal liberty), which aim to protect the dignity and rights of SC/ST communities. The frameworks of the National Commission for Scheduled Castes (NCSC) and National Commission for Scheduled Tribes (NCST) also guide the interpretation and implementation of the Act.
Appointment of Election Commissioners
New Law: The Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act introduces a new procedure for appointments. A Search Committee, headed by the Law Minister, will prepare a panel of names.
