Burden of Proof

What: party that hold sthe responsibility of proving the facts of the case to find the accussed guilty

Prosecution

Bears the burden of proof, those who are accusing of the person of committing a crime

Standard of Proof

What: strength of evidence against the accussed needed to prove a case

Beyond Reasonable Doubt

It means the evidence must be strong enough that there is no reasonable doubt about the accused's guilt.

This is what the Criminal Standard is

Presumption of Innocence

What: Accussed is innocent until proven guilty

How we uphold the presumption of innocence

  • can stay silent

  • burden and standard of proof

  • prior convictions do not matter (unless related)

Two ways it is upheld

Standard and Burden of proof

Relations

  • presumption of innocence is affected by the standard of proof + burden of proof

  • burden and standard both require facts or evidence

  • beyond reasonable doubt relates to both standard of proof and presumption of innocence
