• Establishment Clause

  • Congress shall make no law expecting an establishment of religion

    • Basically, no state religion (except, states could i.e. PA being the Quaker state)

  • Free Exercise Clause

    • The free exercise of religion (no prohibition on exercising)

• Lemon v Kurtzman

  • Made strict guidelines on what was able to pass in terms of what was an establishment of religion (The Lemon Test)

    • 1. Does the law outline a Secular Purpose

    • 2. Does principle effect promote or inhibit religion

    • 3. Does the law create excessive entanglement with religion

      • Very subjective, part of the issue

• Not just the justice, but the “supply” side
