Public law revision

Constitutional law = concerns the exercise of public power within a country

The power to run the country (government)

The power to provide and ensure a fair and just society (courts)

The power to pass laws to this end (parliament)

The consitutional law determines how these institutions exercise their power and male sure its capable of following

We find the most important of these laws in the CONSTITUTION

The Declaration of Independence 1776

America has set themselves free from shackles off British empire

A government based on their own choice and their own system of government not from the mad King, King George the 3rd

The founding fathers made the Us constitution in 1787

Both written and unwritten

Break in the established law cretaes consitution

Eg:

russian revolution lenin

Indian revolution

South sudan splitting from sudan

Consitution law is hter highest law andf is distinct from oridinary laews

The procedure to pass an ordinary law by the congress is 50%+1 majority in the house of representatives +house of senates

To change us consitution u have to 2/3rd or 67% of both houses and ¾ (38) of all states bc its supreme

Gov s only the creator of the constitution its still suprem

codified = set out in one documentin 1 code set out in 1 point in time

uncodified (the Uks) = = ontainedin nunmerous diff sources

The Uk constitutio isnt supreme bc its not 1 singular codified document, containd in different sources (case ;aw, acts of parliaments, case jdements, conventiins- ordinary law)

The constitution is set out in the ordinary law eg: human rghts at 1988 no more special than criminal justice ac

the laws part of the constituin arent more special than any other law

iNSTEAD we look for those who gives us ordinary law -parlioament

can be changed quote easily so not rigid

US is one of the hardest constituions to change

In terms of political rules

Constitutional conventions = these are political rules, habits or processes tht enable the constitution to function

Fedewral states (Us) , central constitution,  all power is allocated to states

Thts y diff states have diff laws

parliament is congress  in the US

Uk is unitary and all authoruty goes back to them

Elected president in Us means u are a republic

Magna Carta1215

King john taxed his barons

narons sick of conatant tacking

magna carta = king has to abide by the law

Someone needs the to advice the king ton wht the law is

Whoch is how parliament came in (institution tht adviced monarch)
