Part I: Preliminary

Application: Subregulation 2(1)
  • Applies to chemicals supplied for use at a workplace:

    • Chemicals:

      • substances

      • mixtures.

Exemptions: Subregulation 2(2)
  • Regulations do not apply to:

    • Radioactive materials under Atomic Energy Licensing Act 1984.

    • Scheduled waste (refer to Environmental Quality Regulations 2005).

    • Cosmetic products governed under Control of Drugs and Cosmetics Regulations 1984.

    • Chemicals used for R&D or trial purposes:

      • Must not be for sale.

      • Limited to a maximum of 5 kg.

      • Must have adequate information available for safe use.

    • Manufactured items exempt if they:

      • Forming a specific shape/design during manufacture

      • has an end-use function dependent on that shape/design.

      • Do not release significant quantities of chemicals posing risks to health under normal use conditions.

Exemption: Subregulation 2(3)
  • Parts II, III, IV, and VI do not apply to pesticides

    • Pesticides Act 1974

    • Chemical in transit before export, which is

      stored in any storage area
