California's First Jail/Prison

  • The Hulk System:
    • Borrowed from the East.
    • The "Euphemia" known as the "Corte Madera".
    • Docked at "Point Quentin".

First State Supported Prison

  • San Quentin:
    • Geb. Vallejo Const. Company.
    • Inmate Labor.
    • First Cell Block opened in 1852.

Second Prison: Folsom

  • Folsom Prison near Sacramento, CA.
  • Independent Administration.
  • Opened in the early 1880s.

California 2 Prison System

  • Judges had discretion to sentence to separate facilities.

Third Prison

  • Near Turn of Century.
  • CIW (California Institution for Women) in Tehachapi, CA.
  • Created due to abuses of women at San Quentin (the Q).
  • Closed due to location expenses.

Delayed Sentencing Type

Suspended Sentence Type

  • Sentence given, but no time is served.

Probation/Split Sentence

  • Serve part of sentence in jail and part on probation.
  • Most common: County jail for 1 year or less, then 3-5 years of probation.
  • In CA, after AB 109, used for prison sentences.
  • Benefit: If probation is violated, credit is given for time served.

Shock Probation

  • Given regular prison or jail term.
  • Granted probation after a 1-3 month period in custody.
  • Usually given to non-violent, first-time offenders.

Probation Conditions

  • Standard Conditions:
    • Obey all laws.
    • Report to PO (Probation Officer).
    • Notify PO of life changes.
  • Special Conditions:
    • Restitution.
    • Employment.
    • Drug testing.
    • GPS.
    • House Arrest, etc.
  • Special conditions connect to the defendant's problems.

Probation Supervision

  • Community Safety is the Primary Goal.
  • RPS (Regular Probation Supervision):
    • Averages caseload of 75-200 probationers.
  • IPS (Intensive Probation Supervision):
    • Averages 8-10 probationers.
  • Probationers are not protected by the 4th amendment.

Probation Violation

  • Technical: Violation of Non-Criminal conditions of Probation Agreement.
  • Non-Technical Violation: Crimes or Criminal Circumstances.
