3 Markers-Due process & Crime control
The crime control model features the idea that repression of crime is the key function of the justice system, because crime threatens people’s freedoms. It starts with the presumption of guilt and assumes police and investigation are skilled and trustworthy at their jobs. This can be seen in UK laws such as Stop and Search powers for any reasonable assumptions of guilt.
The due process model features the idea that the individual must be protected from injustice. This means that the justice system must presume a person is innocent until they are proven guilty. It is supported by the labelling theory which suggests people can be unfairly labelled unless they are protected from this by laws such as PACE.
