Judicial Department in Philippine Politics, Governance, and Citizenship

  • Judicial Authority

Membership and Qualification of the Judiciary

  • Supreme Court Appointments

    • Must be a natural-born citizen of the Philippines.

  • Judges of Lower Courts

    • Appointed judges must be citizens of the Philippines and members of the Philippine Bar.

    • MTC/MCTC Judge: Minimum 30 years old, at least 5 years in practice or public office.

Powers of the Supreme Court

  • Jurisdiction

    • Original jurisdiction over cases involving diplomats and petitions such as:
    • Certiorari
    • Prohibition
    • Mandamus
    • Quo warranto

  • Appellate Jurisdiction

    • Can review, revise, reverse, modify, or affirm judgments of lower courts regarding:

    • Criminal cases involving severe penalties (e.g., reclusion perpetua).

Judicial and Bar Council (JBC)

  • Council Composition

    • Chief Justice as ex-officio Chairman.
    • Secretary of Justice.
    • Congressional representative.
    • Members: a representative from the Integrated Bar, a law professor, a retired Supreme Court member, a private sector representative.
  • Appointments

    • Members appointed by the President with consent from the Commission on Appointments for a 4-year term.
    • Staggered terms for initial appointees to ensure continuity.
  • Functions

    • Main function: Recommend judiciary appointees.
    • Exercise additional functions as prescribed by the Supreme Court.

Appointment and Tenure

  • Judicial Appointment Procedures

    • President appoints Members from a list of at least three nominees from the JBC. No confirmation required.
    • For lower courts, appointments to be made within 90 days from list submission.
  • Judicial Tenure

    • Hold office during good behavior until age 70 or incapacitated.
    • Supreme Court en banc can discipline judges or order dismissal with majority vote.
