Legislative History and Background of RA 9514 and its RIRR

  • Enactment and Authority:

    • Republic Act No. 9514, otherwise known as the "Fire Code of the Philippines of 2008", repealed Presidential Decree No. 1185 (PD 1185).

    • Approved on December 19, 2008, by President Gloria Macapagal-Arroyo after consolidation of Senate Bill No. 2553 and House Bill No. 4115 (passed October 6 and October 8, 2008, respectively).

    • The Revised Implementing Rules and Regulations (RIRR) of 2019 were drafted by the Fire Code Technical Working Group (TWG 2016–2019) under Chief Superintendent Leonides Perez and approved on August 7, 2019, by Secretary Eduardo M. Año of the Department of the Interior and Local Government (DILG).

  • Key Revisions and Milestones in the 2019 RIRR:

    • April 14, 2014: Comments and suggestions were gathered from all BFP Regional Directors to initiate amendments.

    • January 26, 2016: Bureau Order COM-2016-005 created the Fire Code Technical Committee led by SSUPT Roel Jeremy G. Diaz to review LPG provisions following alleged violations by Petronas Energy Philippines, Inc., leading to a comprehensive review of all IRR provisions.

    • August 17, 2017: In response to the House of Representatives inquiry into the Resorts World Manila Fire Incident, Section 9 of RA 7916 (PEZA Law) was amended, conferring sole authority to enforce the Fire Code in Economic Zones to the Bureau of Fire Protection (BFP). FCTS-TWG Resolution No. 1 series of 2017 was signed by SSUPT Felixberto Abrenica.

    • January 18, 2018: BFP and the Philippine Economic Zone Authority (PEZA) signed a Memorandum of Agreement (MOA), followed by Memorandum Circular No. 2018-006 (March 22, 2018) establishing inspection guidelines for PEZA-registered enterprises.

    • Healthcare Facilities Exemption/Adjustment: Section 10.2.11.1 permits critical healthcare facilities (Emergency Rooms, Operating Rooms, ICUs, Delivery Rooms) up to five (5) floors above the level of exit discharge, subject to strict fire-resistive and smoke-proof ramp/horizontal exit requirements.

    • Occupant Load Factor Adjustment: Business occupancies with concentrated use (e.g., Business Process Outsourcing/BPO, Call Centers, IT Centers) reduced the occupant load factor from 9.3 m2/person9.3\text{ m}^2/\text{person} to 4.6 m2/person4.6\text{ m}^2/\text{person} (Section 10.2.16.1).

    • New Special Structures & Occupancies: Standards incorporated for Day Care Centers, Residential Board and Care, Fixed Guideway Transit and Passenger Rail Systems, Historical Structures, Wind Turbine Energy Facilities, Solar Photovoltaic (PV) Systems, Off-Shore Energy Facilities, Motion Picture/TV Production Soundstages, and Road Tunnels.

    • Hazardous Materials & LPG: Established Maximum Allowable Quantities (MAQ), increased regulatory fees, and codified original Philippine standards alongside international norms for Liquefied Petroleum Gas (LPG) (Section 10.3.7.8).
